Step two and three- Case management and discovery:
- Each party is expected to file a CIS with the court within 20 days of the filed answer or appearance. It is also provided to the other party.
- The court schedules a CMC within 30 days of the deadline for filing an answer to the complaint or counterclaim.
- If a court appearance is required, the conference will be over the phone with the judge administrator and attorneys only. Or in person with the parties present.
- If a court appearance is not required a CMC may be bypassed if the attorneys agree.
- The discovery period lasts within 90 or 120 days depending on the track. They may exchange basic discovery, or if necessary, more complex discovery.
